Terms & Conditions of Supply

General

You can not host inappropriate, unreasonable or illegal materials, adult sites or sites which promote illegal activity on our servers - see Acceptable Use Policy

We reserve the right to terminate or suspend any accounts, at any time which we feel violate our terms and conditions or which we feel make inappropriate use of the service. We will not make any refunds for accounts terminated or suspended in respect to this condition.

We are not responsible for any interruption of service, and accepts no liability for any loss of services, sales or any other form of loss.

Backup of all data is the responsibility of the customer not of adeyhost.

Spamming or any type of UCE (Unsolicited commercial e-mail), is strictly prohibited. Accounts may or will be closed immediately if you are found to be doing so.

When your account is set up you will be allocated a username and password. These must not be revealed to a 3rd party.

Hosting is paid for one year in advance, no refunds are available for cancellations made part way through the year.

These terms are further clarified by our Acceptable Use Policy.

Web Service Availability

We shall use our reasonable endeavours to make available to you at all times the Server and the Services but we shall not, in any event, be liable for interruptions of Service or down-time of the Server;

We shall have the right to suspend the Services at any time and for any reason, generally without notice, but if such suspension lasts or is to last for more than 30 days you will be notified of the reason.

The Services provided to you hereunder and your account with us cannot be transferred or used by anyone other than you.

Web Space and Data Transfer

You must not use more web space or data transfer than is allocated to your account. Your allocation can be monitored via your Personal Control Panel. Remember, data transfer includes the serving of web pages, you uploading your web pages and e-mail moving via your account.

Additional data transfer can be purchased at £0.05 per 1mB.

Payment

All payments must be in UK Pounds Sterling. If your cheque is returned by the bank as unpaid for any reason, you will be liable for a "returned cheque" charge of £25

Charges are exclusive of 'Value Added Tax' which shall be paid additionally by you at the rate prescribed by law on submission by us of a proper VAT invoice

Refunds

All accounts come with a 30 day money back guarantee. If you wish to close the account with in the first 30 days just e-mail us and we will arrange a refund of any money paid to you. This refund does not apply to any domain names registered by us on your behalf as they will be registered at the appropriate national registry in your name.

If your account was terminated by us due to a breach of any of our terms and conditions a refund is not available.

Domain Name Registration

These are standard terms and conditions which have been set out by the internet naming organisations.

Adeyhost will onsider all submitted requests for domain name registration and accept or reject them in accordance with guidelines set by Nominet UK and ICANN.

Upon receipt of an order for daomain name registration will submit names for registration. Adeyhost will make payment for the domain name on behalf of the client and invoices issued with regard to this registration must be paid irrespective of wether the client ceases to use our web site hosting service.

The registrant agrees that all details submitted in respect of a domain name registration are true and correct and any alterations made after the initial registration will be also.

adeyhost reserves the right to halt the registration of a domain name if outstanding monies are owed to them by the registrant.

Domain registration requests are processed on a first come, first served basis. Until the registrant receives confirmation of registration from adeyhost there is no guarantee that the domain name requested will be registered.

adeyhost may cancel or halt domain name registrations under certain circumstances, including; where completing the registration puts adeyhost in conflict with guidelines set by Nominet UK or ICANN ; where adeyhost believe that there may be conflicts of rights to a particular name.

adeyhost does not accept any responsibility for the use of registered domain names especially where there may be conflict over rights to ownership.

adeyhost will do all they can to ensure that the registrant's details are submitted correctly during registration but will not be liable under any circumstances for loss of profit suffered by the registrant.

The domain name registration period runs for one year from the date of registration. After this time period has lapsed, registration renewal may be made for periods of one or more years indefinately, upon receipt of payment of renewal fees. NB: Renewal fees are likely to be lower than the cost of initial registration. If this is not the case, the registrant is free to move his/her domain name elsewhere for renewal. No costs will be incurred as a result of this.

The registrant makes certain to adeyhost that the registration of a domain name and the way in which it is used (directly or indirectly) does not infringe the legal rights of any third party.

The registrant indemnifies adeyhost from any legal proceedings and costs that arise as a result of the registration of a domain name.

Data submitted by the registrant pertaining to the registration of a domain name may be available to other organisations and members of the public.

Indemnity

You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to you and your use of the Services and the Server including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by us in consequences of your breach or non-observance of this Agreement.

Emails from us

We will only email you marketing information if you agree to it. Agreement is signified by use of a check box duting order processing.

We reserve the right to alter these terms of conditions at anytime and without notice. These terms and conditions do not affect your statutory rights.
